Terms of Service

1. Agreement to Terms

By accessing heyworkwithdev.com or engaging Work With Dev for services, you agree to be bound by these Terms of Service. If you do not agree, please do not use our website or services.

2. Our Services

Work With Dev provides web design, web development, local SEO, and conversion optimization services primarily for US-based home services companies (plumbing, HVAC, roofing, and similar trades).

Specific scope, timeline, and deliverables for each project are defined in individual project agreements signed by both parties.

3. Project Engagement

How Projects Begin

1. You submit an inquiry via our contact form
2. We schedule a discovery call to understand your needs
3. We send a written proposal outlining scope, timeline, and pricing
4. Upon acceptance and 50% deposit payment, the project begins

Project Timeline

Most projects launch within 21 calendar days of receiving:

• The signed agreement
• The 50% deposit
• All required content and brand materials from you

Delays caused by missing content or delayed client feedback may extend the timeline. We will communicate any timeline impacts in writing.

4. Payment Terms

Standard Terms

• 50% deposit due at project start
• 50% balance due at launch
• Payment via wire transfer or ACH
• Invoices issued before each payment milestone

Late Payments

Payments more than 14 days late may result in:

• Pausing of active project work
• A 5% late fee added to overdue amounts
• Suspension of any hosted services we provide

5. Refund Policy

As stated in our Guarantee:

If you are not satisfied with the design after the first design round, you may request 80% of your deposit back, no questions asked.

After the first design round, refunds are limited to unused portion of services, evaluated case-by-case. We invest real hours into your project — and so do you.

6. Client Responsibilities

For your project to succeed, you agree to:

• Provide content, brand materials, and feedback in a timely manner
• Respond to project communications within 3 business days
• Have authority to approve project decisions
• Pay invoices according to the agreed schedule

7. Intellectual Property

What You Own

Upon final payment, you own:

• The final website design and content
• All custom code we create for your project
• The right to host and modify the site indefinitely

What We Own

• Our process documentation, internal tools, and templates
• The right to display your project in our portfolio (unless you request otherwise in writing)
• Pre-existing code libraries, frameworks, and design systems we use across multiple clients

Third-Party Components

Your site may include third-party libraries, fonts, or assets that remain licensed by their original creators. These are subject to their own license terms.

8. Ongoing Support and Updates

Initial Support Period

Each package includes a post-launch support period (30, 60, or 90 days depending on your package) covering:

• Bug fixes
• Content updates
• Minor design adjustments

After Initial Support

Additional updates, new features, or significant changes are billed separately. We offer ongoing care plans for clients who want monthly support — details available on request.

9. Hosting and Domain

If we set up hosting on your behalf:

• We may use third-party providers (such as Vercel) that have their own terms of service
• Hosting fees may be charged separately from project fees
• You retain ownership of your domain name throughout

10. Confidentiality

Both parties agree to keep confidential any non-public business information shared during the project, including financial details, business strategies, and customer data.

11. Limitation of Liability

To the maximum extent permitted by law:

• Our total liability for any claim is limited to the total amount you paid us for the specific project in question
• We are not liable for indirect, incidental, or consequential damages
• We are not responsible for losses due to factors outside our control (third-party outages, your hosting failures, etc.)

12. Warranties

We warrant that:

• Our work will be performed professionally and to industry standards
• The code we deliver will be free of major defects at delivery
• We have the right to provide the services we offer

We do not warrant:

• Specific business outcomes (number of leads, conversion rates, ranking positions)
• That third-party services we integrate with will function perfectly
• That search engines will rank your site in any particular position

13. Termination

Either party may terminate a project with written notice:

• If we terminate without cause, we'll refund unbilled portions
• If you terminate, fees for completed work are non-refundable beyond the refund policy above
• Material breach by either party (such as non-payment) allows immediate termination

14. Dispute Resolution

For any disputes:

1. First, we'll attempt to resolve through direct conversation
2. If unresolved, mediation in good faith
3. Legal proceedings as a last resort

These Terms are governed by the laws of India. Any legal action must be brought in the courts of Chandigarh, India.

15. Changes to Terms

We may update these Terms from time to time. We'll notify active clients of significant changes via email. Continued use of our services after changes constitutes acceptance.
